PUBLIC CONTRACT

Useful information about the terms of organizing the purchase and sale of goods via the Internet between an individual who makes a purchase (hereinafter referred to as the "Buyer") and the Pulire online store, owned by: Individual entrepreneur BOHDANOVIA KATERYNA VYACHESLAVIVNIA RNOKPP: 3692812504 (hereinafter referred to as the "Seller").

This Agreement is a public agreement (offer) within the meaning of Article 633 of the Civil Code of Ukraine and defines the terms of purchase and sale of goods presented in the Seller's online store.

All relations between the Seller and the Buyer are governed by the provisions of the current legislation of Ukraine, in particular the Law of Ukraine "On Protection of Consumer Rights" .


By accepting this offer — by placing an order and/or making a payment — the Buyer confirms that he has read, understands and fully agrees with the terms of this Agreement.

1. Product information

1.1. The Seller sells hygienic masks for fitting clothes, which are used by the Buyer or a visitor to fitting rooms to protect clothes from contamination and maintain an appropriate level of hygiene during fitting. All masks are a standardized product of the same model and are made of specially selected materials that are safe for contact with skin and textile products.

1.2. The masks for fitting, presented on the Seller's website through photo samples, are original products of the Pulire brand and are manufactured in accordance with the current legislation of Ukraine in the field of non-food product safety.

1.3. Trial masks are not medical devices, do not belong to personal protective equipment for medical purposes, and are not intended for use for medical or sanitary purposes.

1.4. Each photo sample of the product is accompanied by text information: article number, price, description of the purpose and characteristics of the masks, composition of materials, recommendations for use and other data necessary for the Buyer to make the right choice.

1.5. The price of the goods indicated on the website may be changed unilaterally by the Seller. The current price of the goods is indicated directly on the product page at the time of placing the order by the Buyer.

1.6. In the event of a change in the price of the goods after placing an order, the Seller's manager will inform the Buyer as soon as possible (by phone, e-mail or other means of communication specified when placing the order) to obtain confirmation or cancel the order. If it is impossible to contact the Buyer, the order is considered canceled.

2. Product characteristics

2.1. All trial masks sold by the Seller are standardized products of the same model, shape and functional purpose. Description of characteristics, conditions of use, material composition, care recommendations and operating rules of trial masks are published on the Seller's website.

2.2. The images of the product on the site are illustrative and may have minor differences from the actual appearance of the mask, which are related to the conditions of photography, lighting or individual settings of the Buyer's display. Such differences do not affect the functional properties of the product.

3. Goods and procedure for purchasing goods

3.1. All trial masks available for purchase on the Seller's Website are standardized products of the same model, made of hygienic materials that meet the safety requirements for non-food products. Information about the product, including description, characteristics and photo samples, is posted on the Seller's Website.

3.2. The Order can be placed by the Buyer independently through the Site's shopping cart or by calling the numbers listed in the "Contacts" section.

3.3. The Buyer has the right to place an order for any masks for fitting presented on the Pulire Online Store Website, subject to their availability.

3.4. In the event of a temporary absence of the goods ordered by the Buyer in stock, the Seller has the right to remove the goods from the Order or cancel the Order in whole or in part. The Seller shall notify the Buyer of this by phone call, e-mail or other available means of communication specified by the Buyer when placing the order.

3.5. In the event of the absence of goods, the Buyer has the right:

— choose the waiting time for product replenishment;

— replace it with another product from the range;

— refuse a specific product or cancel the order completely.

3.6. The Buyer has the right to cancel the order at any time before it is sent by the delivery service, by notifying the Seller by telephone or other specified communication channel.

3.7. In the event of cancellation of a fully or partially prepaid order, the cost of the relevant product is returned to the Buyer in the same way as the payment was made. The return is made on the basis of the Buyer's application in accordance with the Law of Ukraine "On Consumer Protection".

3.8. The Buyer bears full responsibility for providing inaccurate or incomplete information when placing an order, which makes it impossible or difficult for the Seller to properly fulfill its obligations.

3.9. The Seller does not guarantee the reservation of the goods until the order is confirmed by the manager or until actual payment (unless otherwise provided for by the site terms).

3.10. The estimated date of transfer of the order to the delivery service is communicated to the Buyer by the manager processing the order via email or a check-up call.

4. Price and payment method

4.1. The price of each unit of goods (masks for fitting) is set by the Seller and indicated on the product page on the Online Store Website. The total order price is determined by adding the cost of all goods selected by the Buyer and is displayed on the order processing page.

The cost of delivering the goods is not included in the order price and is paid by the Buyer in accordance with the delivery service tariffs.

4.2. The price of this Agreement is equal to the total cost of the order. The order amount may vary depending on the price of the goods, quantity and assortment selected by the Buyer.

4.3. Payment for goods is made in the national currency of Ukraine - hryvnia, in the method(s) provided for on the Online Store Website.

4.4. The Buyer can pay for the goods by online payment with a bank card (Visa/Mastercard) through the payment system integrated on the Site. Payment data is processed exclusively by the payment provider.

4.5. The order is considered paid from the moment of actual receipt of funds to the Seller's account. The fact of payment confirms the Buyer's familiarization with the terms of this Agreement and his full agreement with them.

4.6. The goods are not reserved until the Buyer's funds are credited to the Seller's account. In this regard, the Seller cannot guarantee the availability of the required quantity of goods in stock at the time of placing the order, which may lead to an increase in the order processing time.

4.7. In the event that a refund is required to the Buyer (in whole or in part), the Buyer is obliged to provide the Seller with the current details of the bank account (IBAN) to which the refund should be made. The refund is carried out in accordance with the norms of the legislation of Ukraine.

5. Product quality and warranty

5.1. The Seller is responsible for the quality, completeness and safety of the trial masks sold in the Pulire online store.

5.2. The Seller guarantees that the goods comply with the description posted on the Site and use materials approved for contact with leather and textile products. Documents confirming the quality of the products can be provided to the Buyer upon request.

5.3. If the Buyer discovers defects in the goods related to a manufacturing defect, the Buyer has the right to file a claim in accordance with the Law of Ukraine "On Protection of Consumer Rights". Such a claim may be filed only if the goods have not been used, have not been unpacked and retain their retail condition and original packaging.

5.4. The Seller is not responsible for damage or spoilage of the goods that occurred due to the fault of the delivery services, carrier or courier after the goods were transferred to them.

5.5. The Seller is not responsible for damage to the goods resulting from improper use by the Buyer or use of the goods for purposes other than their intended purpose.

5.6. The Seller is obliged to transfer to the Buyer the goods that correspond to the description provided on the Site. The description contains a list of consumer properties of the mask for fitting and may be accompanied by photographs or other visual materials.

5.7. No warranty periods are established for trial masks due to their hygienic purpose and specific uses.

5.8. Masks for fitting are sanitary hygiene products and after unpacking or use are not subject to return or exchange in accordance with the Resolution of the Cabinet of Ministers of Ukraine No. 172 of March 19, 1994 (paragraph 3 of the list of goods that are not subject to exchange or return).

5.9. The return of the goods is possible only in the event of a manufacturing defect and only on condition that the goods are not unpacked, have not been used, have their original packaging, seals and presentation. All other cases of return and exchange for masks for fitting do not apply in accordance with the legislation of Ukraine.

6. Delivery and transfer of goods to the Buyer

6.1. Delivery of goods purchased in the Pulire online store is carried out by Nova Poshta or other carriers available in the delivery methods on the Site. Delivery is carried out throughout Ukraine, with the exception of temporarily occupied territories and the Autonomous Republic of Crimea.

6.2. Orders are shipped within Ukraine within 1–3 business days from the moment of order confirmation and/or payment receipt (in case of prepayment). If the payment option “cash on delivery” is selected, the shipment is made within 1–4 business days after placing the order. Sundays and official public holidays are not included in business days.

6.3. The buyer undertakes to check the goods for quantity, quality, appearance and completeness upon receipt of the order from the carrier's representative or courier. After receiving and signing the carrier's documents, claims for damage during transportation are considered in accordance with the rules of the transport company.

6.4. The Seller is not responsible for the delivery times of the goods, as they completely depend on the work of third parties - delivery services.

6.5. In the event of a delay in delivery, damage to the parcel or loss of the shipment, the carrier is responsible in accordance with its internal rules and the legislation of Ukraine.

6.6. The Buyer is not obliged to compensate for the delivery costs if upon receipt of the goods it is discovered that they are of inadequate quality, incomplete or do not correspond to the order due to the fault of the Seller. In such a case, the costs of returning or replacing the goods shall be borne by the Seller.

6.7. In the event that the Buyer rejects goods of proper quality or the order at the time of delivery (except in cases where a defect is detected), the delivery costs shall be borne by the Buyer.

6.8. The delivery time of the order depends on the selected carrier and the distance to the recipient's location and is usually 1–7 calendar days.

7. Product return procedure

7.1. Return or exchange of goods in the online store is possible in cases and in accordance with the procedure specified by the Law of Ukraine "On Protection of Consumer Rights".

Masks for fitting are considered sanitary hygiene products and after unpacking or use are not subject to return or exchange in accordance with the Resolution of the Cabinet of Ministers of Ukraine No. 172 of March 19, 1994 (paragraph 3 of the List).

7.1. 1. Only goods that:

— was not unpacked;

— not used;

— retains its original factory packaging, seals and presentation;

— has no traces of contact with skin or cosmetics.

7.2. The return of the goods is possible by contacting the Buyer through the "Return of goods" form on the website, by sending a letter to the Seller's email address or by phone number specified in the "Contacts" section.

Returns are accepted after approval by the manager.

7.3. In the event that the Buyer returns goods of proper quality (which are subject to return in accordance with the law and are not unpacked masks for fitting), the Seller shall refund to the Buyer the paid cost of the goods upon receipt of the goods at the warehouse , excluding the Seller's costs associated with its delivery to the Buyer.

7.4. Refunds for goods that were not delivered to the Buyer for any reason are made solely on the basis of a written application from the Buyer. Refunds are made to the card account from which the payment was made within 10 banking days from the date of receipt of the application.

7.5. In the event of the Buyer's refusal of goods of proper quality subject to return, the Seller shall refund to the Buyer the cost of the goods, excluding costs associated with delivery, within 10 days from the moment the goods arrive at the warehouse together with the completed application and necessary documents.

7.6. Trial masks that have been unpacked, used, or have traces of contact with skin/cosmetics are not eligible for return or exchange.

8. Rights, responsibilities and confidentiality

8.1. The Pulire online store was created to organize a remote method of selling masks for fitting and other goods via the Internet.

8.2. The Seller is not responsible for the content, completeness and accuracy of the information provided by the Buyer when placing an order. The Buyer is solely responsible for the accuracy of personal and contact information.

8.3. The Buyer is obliged to provide reliable information when placing an order. Using the Online Store website to view products and place an order is free of charge.

8.4. All information provided by the Buyer when placing an order is confidential. The Seller uses the Buyer's personal data exclusively for:

— processing and fulfillment of orders;

— communication with the Buyer;

— delivery;

— providing service support;

— sending information and advertising messages (with the Buyer's consent);

— compliance with the requirements of Ukrainian legislation.

8.5. The Seller undertakes not to transfer the Buyer's personal data to third parties, except for:

— delivery services necessary to fulfill the order;

— banks and payment systems to ensure settlements;

— cases provided for by the legislation of Ukraine.

8.6. Personal data is processed in accordance with the Law of Ukraine "On Personal Data Protection" and the privacy policy of the Online Store.

8.7. If the Buyer does not wish to receive advertising or informational mailings, he has the right to refuse them at any time by contacting the Seller by e-mail or other available method specified in the "Contacts" section.

8.8. In the event of conflict or dispute situations, the parties are obliged to refrain from emotional actions, be guided by the norms of the current legislation of Ukraine and strive to resolve the dispute through negotiations.

9. Force majeure

9.1. The Parties are exempt from liability for partial or complete failure to fulfill obligations under this Agreement if such failure was a consequence of force majeure.

9.2. Force majeure circumstances include: natural disasters, fires, floods, earthquakes, pandemics, military actions, mobilization, strikes, blockades, decisions of state authorities, disruptions in the work of transport or postal services, disruptions in energy supply and other circumstances that do not depend on the will of the parties and make it impossible to fulfill obligations under this Agreement.

9.3. The party for whom force majeure circumstances have occurred is obliged to notify the other party as soon as possible, as soon as possible.

9.4. The occurrence of force majeure circumstances is confirmed by official documents issued by competent state authorities or the Chamber of Commerce and Industry of Ukraine.

9.5. During the period of force majeure, the performance of obligations under the Agreement shall be suspended for the duration of their existence without the application of penalties.

10. Contract validity period

10.1. This Agreement shall enter into force from the moment of its publication on the Online Store Website and shall be valid for an indefinite period.

10.2. For the Buyer, the Agreement is considered accepted from the moment of placing the order and/or making payment for the goods.

10.3. The Agreement regarding a separate order shall remain in effect until the parties have fully fulfilled their obligations:

— By the Seller - until the moment of transfer of the goods to the Buyer;

— By the Buyer — until the full payment for the goods (in case of prepayment) and acceptance of the goods.

10.4. The Seller has the right to terminate or amend the Agreement at any time by publishing a new version on the Site. Placed and paid Orders are fulfilled in accordance with the terms and conditions in effect on the date of placing the Order.

11. Final provisions

11.1. This Agreement is a public agreement within the meaning of Articles 633, 634 of the Civil Code of Ukraine and regulates the relationship between the Seller and the Buyer during the distance purchase and sale of goods.

11.2. The Seller has the right to make changes to the terms of this Agreement unilaterally. The current version of the Agreement is always available on the Online Store Website. Changes come into force from the moment of their publication, unless otherwise provided by the Agreement.

11.3. Use of the Online Store Website and placing an order by the Buyer means the Buyer's full agreement with the terms of this Agreement in the version valid at the time of placing the order.

11.4. The electronic form of this Agreement, including electronic messages, placing an order on the Site and confirming payment, is recognized by the parties as equivalent to the written form of the Agreement.

11.5. All legal relations between the Seller and the Buyer not regulated by this Agreement are governed by the current legislation of Ukraine, including, but not limited to:

— Civil Code of Ukraine;

— Law of Ukraine “On Protection of Consumer Rights” No. 1023-XII dated May 12, 1991 (current version).


11.6. All disputes that may arise between the parties shall be resolved through negotiations. In the event of failure to reach an agreement, the dispute shall be subject to judicial resolution in accordance with the legislation of Ukraine.
